1. Definitions
In these terms: "the Company", "we", "us" and "our" mean Gracechurch Hotel Operator Limited, a company registered in England & Wales under Company Number 06010154, whose registered office is at C/O TMF Group, 13th Floor, One Angel Court, London, United Kingdom, EC2R 7HJ. "The Hotel" means The Gracechurch, the hotel operated by the Company in the City of London. "You" and "your" mean the guest, booker or corporate customer making or using a booking. "Booking" means a reservation for accommodation, dining, private dining, boardroom hire or any other service supplied by the Company.
2. Scope of these terms
These terms apply to all Bookings made directly with the Company, whether by email, through the enquiry facilities on gracechurchhotel.co.uk, or in person. Bookings made through third-party agents or online travel agents are also subject to the terms of the relevant third party; where those terms conflict with these, the third party's terms govern the booking contract, and these terms govern your conduct at the Hotel.
3. Bookings and contract formation
A Booking is an offer by you to purchase services from the Company. A contract is formed only when we issue a written confirmation by email. You must be at least 18 years old to make a Booking. Rates are quoted in pounds sterling and include VAT at the prevailing rate unless stated otherwise.
4. Payment
- We may require a valid payment card to guarantee a Booking. No charge is made to the card until the point specified in your confirmation, except as set out in clauses 5 and 6.
- Prepaid and advance-purchase rates are charged in full at the time of booking and are non-refundable, as stated at the time of booking.
- Unless a Booking is prepaid or covered by an approved corporate account, the balance is payable on departure.
- Corporate account customers are invoiced monthly in arrears; invoices are payable within 30 days of the invoice date. We may charge interest on overdue sums at 4% above the Bank of England base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998.
- We may pre-authorise a payment card on arrival for the amount of the stay plus a reasonable sum for incidentals.
5. Cancellation and amendments
- Flexible rates may be cancelled or amended free of charge until 2 pm (London time), two days (48 hours) before the arrival date.
- Cancellations received after that time, and failures to arrive ("no-shows"), will be charged at the full price of the first night, or as stated in your confirmation.
- Prepaid and advance-purchase rates cannot be cancelled or amended, and no refund is due, except as required by law.
- Group bookings and private dining or boardroom hire may be subject to separate cancellation schedules, which will be set out in the written proposal for the event and will prevail over this clause for that event.
6. Your consumer rights
Where you book as a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015, including your right to services performed with reasonable care and skill, and to a price reduction or refund where services are not provided as described. If we cancel your Booking, we will refund all sums you have paid for the affected services.
7. Arrival, departure and conduct
- Rooms are available from 3 pm on the arrival date and must be vacated by 11 am on the departure date. Late check-out until 1 pm may be available on request, subject to availability.
- The Hotel is non-smoking throughout, including e-cigarettes. A cleaning charge of £150 may be applied where this policy is breached.
- You are responsible for damage caused by you or your party beyond fair wear and tear, and we may charge the card on file for the reasonable cost of repair or replacement.
- We reserve the right to refuse service or end a stay without refund where a guest's conduct endangers or unreasonably disturbs other guests or staff.
- Pets are not permitted, with the exception of assistance dogs, which are always welcome.
8. Availability and changes by us
Occasionally, circumstances beyond our reasonable control may require us to change or cancel a Booking. In that event we will contact you as soon as practicable, offer comparable alternative arrangements where possible, and refund any sums paid for services we cannot provide. This is the extent of our liability in such circumstances, save as required by law.
9. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Subject to that:
- our total liability to you in connection with a Booking shall not exceed the total price paid or payable for that Booking; and
- we are not liable for losses that are not reasonably foreseeable, nor for loss of profit, loss of business or other indirect or consequential loss where you book in the course of a business.
Guest property is accepted and held at the Hotel subject to the Hotel Proprietors Act 1956.
10. Intellectual property
All content on gracechurchhotel.co.uk — including text, design, logos and imagery — is owned by or licensed to Gracechurch Hotel Operator Limited and is protected by copyright and other intellectual property rights. You may view and print pages for personal, non-commercial use only. No other use is permitted without our prior written consent.
11. Force majeure
We are not liable for any failure or delay in performing our obligations where the failure or delay results from events beyond our reasonable control, including fire, flood, extreme weather, epidemic or pandemic, strikes, utility failure, or acts of government or public authorities. Where such an event continues for more than 14 days, either party may cancel the affected Booking and we will refund sums paid for services not provided.
12. Data protection
Personal data collected in connection with a Booking is processed in accordance with our Privacy Policy and Cookie Policy.
13. Governing law and disputes
These terms, and any contract formed under them, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident elsewhere in the United Kingdom may bring proceedings in their local courts. We encourage you to contact us first at info@gracechurchhotel.co.uk with any complaint so we can try to resolve it directly.
14. General
- If any provision of these terms is found to be unenforceable, the remainder continues in force.
- A failure to enforce any right is not a waiver of that right.
- These terms, together with your written confirmation and any proposal for an event, constitute the entire agreement between you and the Company in relation to a Booking.
- We may update these terms from time to time; the terms in force at the date of your Booking apply to that Booking.
